Defense Against Common Probation Violation Allegations
A probation violation does not automatically mean you will return to jail or prison. The outcome depends on the alleged violation, your original sentence, your probation history, and the available evidence.
We represent clients facing allegations involving:
Missed reporting: Failing to attend a scheduled appointment with your probation officer or report as required.
Drug or alcohol violations: Positive drug tests, missed testing appointments, or failure to complete required substance abuse treatment.
New criminal charges: Arrests or allegations of criminal activity while serving probation.
Unpaid fines or restitution: Falling behind on court-ordered payments or other financial obligations.
Failure to complete programs: Missing required counseling, community service, or treatment sessions.
Other probation conditions: Traveling without permission, violating contact restrictions, or failing to comply with supervision requirements.
We review the violation report, supporting evidence, and circumstances that may explain or challenge the allegations. For example, medical records may explain a missed appointment, while testing procedures or results may warrant closer examination in a drug-related violation.
If your alleged violation involves a new criminal charge, we can also evaluate the related criminal proceedings and how they may affect your probation case.
Representation at Missouri Probation Violation Hearings
If you are accused of violating probation, you may receive a notice to appear in court or face an arrest warrant. A hearing allows the court to determine whether a violation occurred and whether revocation is warranted.
Under Missouri Revised Statutes § 559.036, probation generally cannot be revoked without notice and an opportunity to be heard. A new criminal conviction is not always necessary to establish a violation, and the evidentiary standards differ from those in a criminal trial.
At Grantham Fiester Law, we can help you prepare for the hearing by:
Reviewing the allegations and supporting evidence.
Challenging inaccurate reports or unreliable evidence.
Presenting documentation explaining missed obligations or alleged noncompliance.
Demonstrating your compliance with other probation requirements.
Advocating for continued probation or another appropriate resolution.
We also help you understand what to expect in court and how your original sentence may affect the available outcomes.

Protecting Your Options When Probation Revocation Is Possible
Missouri courts have several options when addressing probation violations. A judge may continue probation under the existing conditions, modify its requirements, extend supervision within statutory limits, or, when legally appropriate, revoke probation.
If the court revokes probation, the consequences depend partly on how your original sentence was structured:
Suspended Execution of Sentence (SES): If the court imposed a sentence but suspended its execution, revocation may require you to serve that sentence.
Suspended Imposition of Sentence (SIS): If the court suspended sentencing when probation began, revocation may allow the judge to impose a sentence for the underlying offense.
Certain eligible probationers may also qualify for a 120-day Missouri Department of Corrections program instead of immediate revocation. Eligibility depends on statutory requirements, including the underlying offense, the type of violation, and prior program participation.
We evaluate which options may apply and advocate for an appropriate outcome based on the circumstances of your case.
Alternatives to Incarceration
When supported by the evidence and applicable law, we may seek continued probation, modified supervision conditions, additional treatment, or other available alternatives to incarceration.
For example, if a violation involves unpaid restitution or fines, the court must consider whether the failure to pay was willful or resulted from an inability to pay before revoking probation solely for nonpayment.
Evidence of employment, treatment participation, compliance with other conditions, and efforts to correct a violation may also be relevant when requesting continued probation.
Our goal is to present the strongest available arguments for protecting your freedom while addressing the court's concerns.
